Paying debts is legally obligatory, in fact it has to be expedited especially when it is due (ajal musamma).

Al-Imam Al-Ghazali Rahimahullãh mentions a history from Hatim Al-Ashom Rahimahullãh, that he said:

العجلة من الشيطان إلا في خمسة، فإنها من سنة رسول الله صلى الله عليه وسلم: (إطعام الطعام، وتجهيز الميت، وتزويج البكر، وقيونب الذنب).

“Haste is from satan, except in five (things), because it is included in the sunnah of the Prophet salallãhu 'alaihi wasallam (namely): (feeding, preparing for the burial of the deceased, marrying virgins, paying off debts, and repenting of sin)."

Then what if the person giving the debt is difficult or even cannot be found? In other words, in terms of now, contact has been lost.

If faced with such circumstances, then the obligation to pay debts still exists. Do not let someone die in a state of debt or pass it on to their heirs to pay it off.

If the maximum effort to find the person who gave the debt is unable to produce results, then the debt can be paid to the heirs.

However, if it turns out that the heir cannot be found or is no longer there, then the last option is to give charity on behalf of the person giving the debt so that the alms reward is given to the creditor. Then get rid of debt obligations.

However, if one day you meet the creditor or his heirs, then inform him that the nominal amount of the debt has been donated on behalf of the creditor.

If he is pleased, then the reward is alms for him. But if he collects, then pay the debt to him & the reward will belong to the person who owed & gave alms earlier.

This is in accordance with the history that Abdullah Ibn Mas'ud radliyãllahu 'anhu once bought slaves. When he entered the house to count the money to be paid, it turned out that the slave trader had left. He then waited for him, until Ibn Mas'ud gave up hope that he would return.

Finally, Ibn Mas'ud gave the slave money in charity, and he prayed:

O God of Allah

“O Allah, this is in the name of the master of the slave. If he is pleased, then he gets the reward. But if he comes, the reward is for me and he deserves my reward equal to that alms."

Hope it is useful…

Peace, mercy and blessings of God
