Positive Covid Reluctant Isolation and Quarantine Can Be Penalized

Because, there are criminal threats for certain violations, especially related to isolation and self-quarantine.

Security Secretary Chris Tang said on Friday, March 11, 2022, that a Hong Kong resident who refuses to go to an isolation facility after testing positive for Covid in a rapid test could be prosecuted. Tang said this was related to a visit by officials the day before to 79 people who were infected and were reluctant to move to isolation. One of them still refuses to stay in isolation.

"We are reviewing the evidence, we can charge the person by issuing a summons later," Hong Kong's security minister said, as reported by RTHK.

Previously, RTHK reported, a 52-year-old woman was sentenced on Wednesday by the Kowloon City Magistrates Court to 14 days in prison, suspended for 12 months, for violating a mandatory quarantine order in July 2021. After being ordered to quarantine at home for 14 days, the woman was discovered has left his residence on July 8, before the expiry of the order, without reasonable reason, or has obtained permission from the competent authority.

"A spokesperson for the Ministry of Health said the sentence sends a clear message to the public that violating the quarantine order is a criminal offence, and reminds the public of the need to comply with regulations," RTHK wrote.

Offenders can be fined a maximum of HK$25,000 and six months in prison. To date, a total of 221 people have been convicted by courts of violating quarantine orders, receiving sentences including direct imprisonment of up to 14 weeks and fines of up to HK$15,000.

In addition, it was also reported that a man appeared in court on Wednesday for allegedly visiting a restaurant on purpose after testing positive for Covid through a rapid test. The 28-year-old is accused of exposing others to infection by visiting the Genki Sushi branch at Plaza Hollywood on Diamond Hill on February 28, even though he was aware he had the coronavirus.

The Kowloon City Court denied bail for the accused, and adjourned the trial until April 20 so police can conduct further investigations and seek legal advice. [DDHKNews]
