Not Giving Loans When You Need

DDHK. ORG – Loans or debts are familiar things in everyday life. Providing loans is highly recommended to those in need. Especially on brothers. But what if that owed even do not know themselves and borrow again, is it a sin if you don't lend it? Listen consultation the following.

Is it my sin, if my brother wants to borrow money but I don't give it because he used to borrow money too but it hasn't been paid for up to three years on the grounds of paying for his child's school fees.

Helping other people's difficulties is a matter that is highly recommended. From Abu Hurairah radliyãllahu 'anhu, Rasulullah shallallãhu 'alaihi wasallam said:

Amen Amen O Allah, the Most High, the Most Merciful

"Whoever relieves a believer's distress (sadness) in this world, Allah will relieve his distress on the Day of Judgment. Whoever makes it easy for someone who is in a difficult situation, Allah will make it easy for him in this world and the hereafter. Whoever covers someone's disgrace, Allah will also cover his disgrace in this world and the hereafter. Allah will always help His servant, as long as the servant helps his brother." (Muslim HR)

Among the acts of helping other people's difficulties is giving him a loan. As long as the debt used is for permissible needs. However, if the debt obtained is intended for things that are makruh, let alone unlawful, then lending it is not permissible.

In line with what Shaykh Wahbah Al-Zuhaili mentioned in his book Al-Fiqhul Islami wa Adillatuhu:

'Borrowing is a recommended worship. This is based on the word of Allah:'

"Let you help each other in kindness and piety." {QS Al-Maidah: 2}

So what happens if the debtor hasn't paid off his debt but wants to owe more?

Basically debt is helping others. But there must be an agreement and notes in it. Allah Subhanahu wata'ala says:

یَـٰۤأَیُّهَا ٱلَّذِی tow ء امَنُوۤا۟ إِذَا تَدَایَنتُم بِدَیۡنٍ إِلَىٰۤ أَجَلࣲ مُّسَمࣰّى فَٱكۡتmi.

"O you who believe, when you make debts for a specified time, then you should write it down." {QS Al-Baqarah: 282}

This means that there must be clarity and agreement on when the payment will be made between the two parties; lenders and borrowers.

But if it comes to the repayment period the borrower has not been able to pay off his debt, then give him a grace period. Allah Subhanahu wata'ala says:

وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍ وَأَنْ تَunt

“And if (the person who owes it) is in trouble, then give respite until he is spacious. And giving (part or all of the debt) is better for you, if you know." {QS. Al Baqarah: 280}

Rasulullah shallallãhu 'alaihi wasallam also said:

مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ عَنْهُ أَظَلَّهُ اللَّهُ فِى ظِلِّهِ (رواه مسلم)

"Whoever gives a grace period for people who are in trouble to pay off debts or even free their debts, then he will get the shade of Allah." (Muslim HR)

If the debtor has not been able to pay off his debt but wants to owe more, then what we should pay attention to is:

1. For what purpose does he want to owe again.

2. Look at the history of the debtor, especially his morals and manners

3. See our capabilities.

If the three factors above are fulfilled properly, borrowing it again is permissible even good. But if there is one factor that is not fulfilled properly, then we are not sinful if we don't lend it again. It could even be a lesson for him.
