Toenails are torn by themselves, is the sacrifice valid?

Assalamualaikum. Ustadz, I want to ask a question.

This is my fingernail that is tearing itself without cutting it, suddenly it just torn. Is the sacrifice valid?

ANSWER:

Wassalamu'alaikum warahmatullahi wabarokaatuh.

Bismillah... Narrated by Umm Salamah radliyallãhu 'anhã, the Prophet sallallaahu 'alaihi wasallam said:

“إذا لالَ الحجةِ، اد أن ليُمسك وأظفارِهِ” (رواه لم)

"If you see the new moon of Dzulhijjah while one of you is about to make a sacrifice, then let him restrain (not cutting) his hair and nails." (HR Muslim)

From this hadith, there are two opinions regarding the issue of shaving, shortening, or cutting off parts of the body such as hair and nails for people who will sacrifice from the 1st of Dhulhijjah until the sacrificial animal is slaughtered. The two opinions are:

  1. The majority of scholars are of the opinion that not shaving, shortening, or cutting is a sunnah. As for the prohibition of shaving, and so on, it is only tanzih (close to halal) not tahrim (close to haram). So that the person who shaves part of his hair or cuts his nails between the 1st and 10th of Dhul-Hijjah when he wants to sacrifice, then he is not sinning. It's just that not shaving or cutting is much better and gets an extra reward.
  2. Shaykh Bin Bãz from Saudi Arabia is of the opinion that the prohibition of shaving or cutting part of the hair or nails is haram. The prohibition applies to the person who sacrifices and he himself who slaughters the sacrificial animal. As for if he delegates the slaughter to someone else, such as a sacrificial committee or others, then it is permissible for him to cut his hair or nails.

The wisdom of not cutting or shaving for the person who sacrifices is:

  1. So that more and more members of his body will be witnesses of his goodness and more will be freed from the torments of hell,
  2. Resembling what the pilgrims do in the holy land.

So, if someone cuts their hair or nails between the 1st and 10th of Dhul-Hijjah even though he is about to make a sacrifice, then the qurbani is still valid, especially for those whose nails accidentally tear and fall off.
