Peace, mercy and blessings of God

Ustadz, I want to ask a question.

Can we borrow money from the bank for parental surgery costs?

Thank you, Ustadz.

Greetings, Fulanah

ANSWER:

Peace be upon you and God's mercy and blessings be upon you

Thanks for the question.

Islam regulates all aspects of life, so that humans who are sent as caliph fil ardh can live safely and peacefully in the world. So that the balance in life is perfectly established.

These rules can be grouped into two. The first is about the procedures for dealing with fellow human beings (muamalah). The second is the relationship with God as creator (worship).

One of the muamalah practices is borrowing and borrowing, this has become part of the daily life of the community, both involving goods, money, land, and other objects. Since the time of the Prophet Muhammad, this activity has been practiced and continues to develop. Now there are many financial institutions that are specifically involved in this business. For example, savings and loan cooperatives, banks, and others.

This practice in Arabic is qardh, its meaning is almost similar to buying and selling. Literally, the meaning is the transfer of property rights over assets. According to Hanafi's understanding, qardh is a property that has the equivalent given, then billed again.

The scholars allow this transaction. The basis is the hadith of the Prophet narrated by Ibn Majah. "It is not a Muslim (them) who lends a Muslim (other) twice, unless one of them is (of) alms". This is the statement of the Prophet.

For those of us who want to borrow money, either to other people or to the bank, someone must have a strong intention to pay it later when it is due. This is in accordance with the hadith of Hurairah: "Whoever takes human property (debt) with the intention of paying it off, Allah will pay it off. And whoever is in debt with the intention of harming him, Allah will destroy him." (Hadith narrated by Bukhari).

Therefore, what needs to be considered in borrowing and borrowing from banks, first, borrowing and borrowing should be in Islamic banks because the contracts are clear. Second, it takes intention and effort to be able to return it. Third, keep trying your best so that Allah will provide you with sufficient to meet your needs, while putting your trust in Him.

Wallâhu a'lam bish-showâb.

Peace, mercy and blessings of God
