The Law of Eating Tortoise Meat

The Law of Eating Tortoise Meat

Peace, mercy and blessings of God

Ustadz, I want to ask a question.

Is turtle meat haram to eat, or not haram?

Thank you, Ustadz.

Greetings, Fulanah

ANSWER:

Peace be upon you and God's mercy and blessings be upon you

Turtle or tortoise in Arabic is referred to as sulhafah. One of the most prominent characteristics of this animal is that it has a shell on its back. In the animal category, turtles are Barma'I animals (animals that live in two realms).

Imam Nawawi, a Syrian scholar from the Shafi'iyyah circle in his book "Roudhotu Ath-Tholibin Wa 'Umdatu Al-Muftin" said:

التمساح لى الصحيح السلحفاة لى الأصح

"According to the most authentic (most authentic) opinion, turtles are animals that are forbidden to eat."

Scholars in the Maliki School are of the opinion that animals that can live in two realms, such as the turtle or crocodile, are still judged to be animals that live in one realm only. The Maliki school of thought does not forbid animals that live in two realms.

Hanabilah and Malikiyah scholars are of the opinion that it is lawful to eat sea turtles after being slaughtered. As for the tortoise, according to the qaol rojih of the Hanabilah scholars, it is unlawful.

Responding to this difference of opinion, quoting the opinion of Ibn Arabi, he said, "The truth is, animals that live in the two worlds (land and water) should not be eaten because there is a conflict between two arguments, namely the argument that justifies and the argument that forbids. So we win the forbidden, because for the sake of prudence and as an effort to protect ourselves (from things that are considered doubtful or doubtful)."

If you do what is doubtful, you are very worried that you will slip into what is haram. In the hadith narrated by Bukhar and Muslim, it is stated, "Whoever is careful and keeps himself from doubts, he has indeed guarded his religion and honor. And whoever falls into doubt means he falls into the forbidden."

Wallâhu a'lam bish-showâb.
